Lateef Fagbemi (SAN), who holds the dual roles of Attorney General of the Federation and Minister of Justice, recently provided an update regarding the ongoing presidential pardon process. He confirmed that, to date, none of the inmates recommended for clemency have been released.

During a detailed briefing in Abuja on Thursday, Fagbemi explained that the pardon procedure is currently in its final administrative phase. This stage involves a thorough review to ensure all nominees satisfy the strict legal and procedural standards before any official approval for release is granted.

He further noted that once the Council of State provides its endorsement, an official directive will be issued to commence the clemency process. This directive initiates a last round of verification and allows for any necessary corrections before the final list is handed over to the Controller-General of Corrections for implementation.

“This verification step is a routine but crucial part of the process, underscoring the administration’s dedication to due diligence,” the statement emphasized.

Fagbemi also highlighted the strong public interest surrounding the pardon exercise, stressing that active participation from citizens is essential to fostering transparency and accountability within government operations.

“The enthusiastic involvement of Nigerians demonstrates a collective commitment to justice and good governance,” he remarked.

Addressing concerns about potential delays, the Attorney General assured that the process is progressing strictly in line with legal requirements, with no unnecessary hold-ups.

“There is no delay; the procedure is being carried out in full compliance with the law to ensure that only those truly qualified receive the President’s mercy. Once all verifications are finalized, the public will be promptly informed. Respecting the rule of law means prioritizing fairness over haste,” Fagbemi stated.

The constitutional authority to grant pardons, as outlined in Section 175 of the 1999 Constitution (as amended), empowers the President to extend clemency to eligible prisoners based on comprehensive legal advice and recommendations.
